Subject: For The Complaints against the TV programs broad-casted on several TV channels.
Dear Sir/Madam
It has been observed that IBFC runs a notice on all the TV channels asking the viewers and general public to report about the objections they have about any program which TV channels air on Indian TV through various DTH and Cable operators.
This kind of notice runs through almost every channel and every program, here I would like to state that there are some programs hosted and aired by Sony Entertainment as well as Star Bharat ie- Crime Patrol & Saavdhan India for which even IBFC can also take the action without general public reporting the objections.
1. Crime Patrol (हिंदी: क्राईम पेट्रोल, मराठी: क्राईम पॅट्रोल, ਪੰਜਾਬੀ:ਕਰਾਈਮ ਪੈਟਰੋਲ ) is an Indian crime reality television anthology series created by Subramanian S. lyer for Sony Entertainment Television India and Sony Entertainment Television Asia.
2. Savdhaan India – India Fights Back (English: Attention India! – India Fights Back) is a 2012 Indian Hindi-language crime show aired by Star Bharat and STAR Utsav owned by STAR India.
Both the programs are depictions of crimes happening in the society. Now the issues that I personally have observed in these programs is the Custodial Torture By the Police to the Person so arrested.
Several Issues that I have with the program-
1. Police in India do not have any right to torture and harass any person in their custody.
2. Police is not the decision maker to decide whether a person is criminal or not. Its the part of the Judicial System of the India and only Judges in the court can decide if the person is guilty of the crime or not and only court and judges of India has the right to punish a person.
3. In both the above programs in almost 95% episodes police are seen torturing the people, slapping them, hitting them with sticks to confess their crime. It is to be reported to you that Under Section 330 & 331 of IPC
IPC Section 330
Voluntarily causing hurt to extort confession or to compel restoration of property
Description
Whoever voluntarily causes hurt, for the purpose of extorting from the sufferer or from any person interested in the sufferer, any confession or any information which may lead to the detection of an offence or misconduct, or for the purpose of constraining the sufferer or any person interested in the sufferer to restore or to cause the restoration of any property or valuable security or to satisfy any claim or demand, or to give information which may lead to the restoration of any property or valuable security, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
IPC 331
Voluntarily causing grievous hurt to extort confession, or to compel restoration of property
Description
Whoever voluntarily causes grievous hurt for the purpose of extorting from the sufferer or from any person interested in the sufferer any confession or any information which may lead to the detection of an offence or misconduct, or for the purpose of constraining the sufferer or any person interested in the sufferer to restore or to cause the restoration of any property or valuable security, or to satisfy any claim or demand or to give information which may lead to the restoration of any property or valuable security shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
Now as you can see that both the IPC are criminal offense and police force can not use physical assault to people in their custody but this is openly seen in both the above programs, therefore it is well understood that such criminal activity is promoted through both these programs.
In both the above TV series like crime patrol & savdhaan india police are shown to be heros with heroic dialogues and using physical assault on the people in their custody and giving a false and misleading information about the ACT.
Now the question thus arise is that why IBFC needs people to report such issues on such programs aired on TV like the two mentioned here.
I fully understand and believe that IBFC is an eminent organization and must have hired well educated, literate & sound mind people as their employee who must be knowing the laws, rules & regulations more than a common citizen and at the first place its the duty of IBFC to stop airing such programs rather than waiting for a common citizen to report such issues.
I hope you will understand what I mean through this open letter and would hold of this and will note that from future, showing such notice or warnings on TV channels means nothing if at the first place IBFC itself stop airing such programs rather than waiting for citizens to report such issues.
Criminal Activity is criminal activity whether it is report or not and organizations likes yours should not wait for others to report such activities rather must take action suo moto. Such programs should never be aired on any TV channels which mislead the common people and citizen and shows the crime as an Heroic Act and propagate the criminal activities believed to be right.

Regards
Nitin Naresh
