Touching Without ‘Skin To Skin’ Contact Is Not Considered Sexual Assault: Bombay HC’s Terrible Point Of Reference

The order passed by the Nagpur seat peruses as follows: 

“The demonstration of squeezing of the bosom of the kid matured 12 years, without a particular detail regarding whether the top was eliminated or whether he embedded his hand inside top and squeezed her bosom, would not fall in the meaning of ‘sexual harassment’. 

The court said that to qualify as assault, the demonstration more likely than not been submitted with sexual expectation, and the Act should include contacting the vagina, penis, anus, or breast of the youngster. The court noticed the meaning of sexual assault as: “Whoever, with a sexual plan, contacts the vagina, penis, anus or breast of the kid or makes the kid contact the vagina, penis, anus or breast of such individual or some other individual, or does some other Act with a sexual goal which includes actual contact without penetration, is said to submit under sexual harassment.” 

The court added, “according to the meaning of ‘sexual assault’, an ‘actual contact with sexual expectation without penetration’ is a fundamental element of the offense,” adding that it can’t consider the minor’s guidance’s contention that it will be assault, since “Thus, there is no immediate actual contact for example skin to skin with sexual expectation without penetration.” 

The court, notwithstanding, said that the demonstration would unquestionably fall inside the meaning of the offense under Section 354 of the Indian Penal Code (Outraging a lady’s unobtrusiveness), and requested the charged’s capture under the equivalent.
